These Terms explain how VPS Malaysia services may be used, paid for, cancelled and supported. By signing up for or using VPS Malaysia services, you agree to these service rules and related policies.

What you accept
Please read these Terms carefully before signing up for or using VPS Malaysia services. Continued use of the services means you agree to the Terms of Service, acceptable use rules and related service policies.
VPS Malaysia may update policies at any time without prior notice or permission. Customers are responsible for keeping account information current and using the services only for lawful purposes.
Account
Customer responsibilities
Account ownership, credential security and hosted content remain under the customer's control and responsibility.
Customers must be at least 18 years old and provide true, current and complete account information.
Accounts may not be transferred or sold to another party.
Customers are responsible for protecting account credentials, billing details, systems, websites, files, directories and data.
All activity under the account remains the customer's responsibility.
Billing
Payment and service timeline
Invoices are automated. Customers must keep billing details and email addresses accurate to avoid missed notices.

| Standard grace period | Payment should be completed within 7 days after the due date to avoid suspension. |
| Standard termination | Unpaid services may be terminated after 14 overdue days, with files removed and no recovery claim available. |
| Dedicated server suspension | Dedicated servers may be suspended 3 days after the due date. |
| Dedicated server termination | Dedicated servers may be terminated after 7 overdue days; continuation depends on availability and may require an IP change. |
| Activation | Most services are provisioned automatically after payment. Orders requiring manual review may take up to 24 hours. |
| Unpaid orders | Orders without payment within 24 hours from the order date may be cancelled automatically. |
Cancellation
Ending or suspending services
Cancellation requests should be submitted through the client portal and may require additional billing information.

| Partial refunds | No partial refunds are provided for unused time after cancellation. |
| PayPal subscriptions | Customers must cancel their own PayPal subscriptions when a service is no longer active or needed. |
Acceptable Use
Prohibited activity
Services may only be used for lawful purposes. Risky or abusive activity may cause immediate suspension or termination.
Illegal or harmful content
Unlawful material, threats, obscenity, trade-secret violations, copyright infringement, hate-provoking or discriminatory content.
Adult content
Adult content and content that links to adult content are not permitted.
Spam
Spam, spamvertised sites, non-opt-in email lists, mail bombers and spam scripts are prohibited.
Network abuse
DDoS activity, port scanning, IP spoofing, open proxies, malware, Trojans and security-compromise scripts are prohibited.
IRC and bots
IRC, IRC bots, psyBNC, eggdrop and related programs are not allowed.
Fraud and harassment
Fraud, harassment, abusive behaviour toward staff and activity that creates liability or service risk are prohibited.
Service Operations
Hosting, backups and resources
Operational rules protect server stability, network performance and other customers on shared infrastructure.

| Resource usage | Processes that excessively consume CPU, memory, network or server resources may be suspended without prior notice. |
| Maintenance | VPS Malaysia uses commercially reasonable efforts to provide 24/7/365 service, with scheduled maintenance normally announced in advance. |
| Backups | Provider backups are for disaster recovery best effort only and are not guaranteed for customer restoration. |
Refunds
30-day money back guarantee
Refund eligibility is product-specific and applies only to qualifying new registrations.

| Excluded fees | Processing, administration, setup, license, domain registration and installation charges are excluded. |
| Refund timing | Credit Card or PayPal refunds may take up to 30 days. Online Banking refunds may take up to 45 days. |
| Free domain condition | If a free domain was included and the service is cancelled within the refund period, the domain registration fee remains payable. |
Reliability
Network uptime guarantee
VPS Malaysia provides a 99.9% network uptime guarantee, excluding scheduled maintenance and events outside reasonable control. Eligibility is determined from VPS Malaysia network monitoring records and applies to network uptime only, not individual server uptime.
Referrals
Referral eligibility
- Referrals are approved case by case and may be withheld when a signup appears fraudulent.
- Shared web hosting, VPS and dedicated server plans may qualify.
- Existing customers, previous customers and self-referrals are not eligible referrals.
- Commission activation requires a minimum active service period: 3 months for shared hosting or VPS, and 2 months for dedicated servers.
Legal
Liability, disputes and acceptance
These legal terms define responsibility limits, dispute handling and the effect of continued service use.
Limitation of liability
VPS Malaysia is not responsible for direct or indirect damages, including data loss, service interruption or lost profits.
Indemnification
Customers agree to defend and hold VPS Malaysia and its affiliates harmless from claims arising from service use or Terms violations.
Breach of Terms
VPS Malaysia may suspend or terminate immediately without notice or liability when the Terms are breached. Fees remain payable up to termination.
Warranty disclaimer
Services are provided as is and as available, without guarantees that they will be uninterrupted, error-free, secure or fit every requirement.
Dispute resolution
Parties should first negotiate in good faith. If unresolved after 30 days, disputes may proceed to mediation or arbitration under Malaysian law.
Acceptance
Using the services confirms acceptance of these Terms and continued use after changes confirms acceptance of updated Terms.
